1. Introduction

Arrio & Kelsey (“we,” “us,” or “our”) is a real estate team affiliated with Coldwell Banker Kennon & Parker, licensed in the States of Georgia and Alabama. We serve Columbus, Georgia; Phenix City, Alabama; and the communities surrounding Fort Benning, with a particular focus on military families relocating under Permanent Change of Station (PCS) orders.

This Privacy Policy describes how we collect, use, disclose, and safeguard information when you visit arrioandkelsey.com (the “Site”), use our mortgage and housing allowance calculators, submit a form, or otherwise communicate with us.

Please read this Policy carefully. By using the Site, you acknowledge that you have read and understood it. If you do not agree with our practices, please do not use the Site.

2. Information We Collect

2.1 Information You Provide Directly

We collect information you voluntarily submit, which may include:

  • Identifiers: name, email address, telephone number
  • Transaction interest: whether you are buying, selling, investing, or exploring; your relocation or PCS timeline; your target neighborhoods, counties, or school zones
  • Calculator inputs: home price, down payment percentage, interest rate, loan term, county selection, property tax and insurance estimates, military pay grade, and dependency status
  • Communications: the content of messages, inquiries, and correspondence you send us
  • Consent records: whether you affirmatively consented to be contacted, together with the date, time, IP address, and page URL at which consent was given

2.2 Information Collected Automatically

When you access the Site, we and our service providers automatically collect:

  • IP address and approximate geographic region derived from it
  • Browser type and version, operating system, and device type
  • Referring URL, pages viewed, time spent on pages, and click activity
  • Date and time of access
  • Information collected through cookies, pixels, and similar technologies

2.3 Analytics

We use Google Analytics 4 to understand Site usage. Google Analytics collects information through cookies and similar technologies and processes it under Google’s own privacy policy, available at policies.google.com/privacy. You may opt out of Google Analytics across all websites by installing the Google Analytics Opt-out Browser Add-on at tools.google.com/dlpage/gaoptout.

2.4 Information We Do Not Collect

We do not knowingly collect Social Security numbers, government identification numbers, financial account numbers, credit card numbers, or credit report data through this Site. Do not transmit such information to us by web form or unencrypted email. Where such information is required in the course of a transaction, it will be collected through appropriate secure channels by a lender, title company, or transaction management system, not through this Site.

3. How We Use Information

We use the information described above for the following purposes:

  • To respond to inquiries and provide real estate brokerage services
  • To deliver calculator results you have requested by email
  • To send property listings, market updates, relocation guides, and other communications relevant to your stated interests
  • To match you with appropriate listings and, where applicable, to enroll you in automated listing alert services
  • To coordinate with lenders, inspectors, title companies, and other transaction professionals at your request
  • To operate, maintain, analyze, and improve the Site
  • To detect, prevent, and address technical issues, fraud, and security incidents
  • To comply with legal, regulatory, licensing, and recordkeeping obligations under Georgia and Alabama real estate law and applicable federal law

4. Calculator Data — Specific Notice

Our mortgage payment and Basic Allowance for Housing (BAH) budget calculators generate estimates for informational and planning purposes only. They do not constitute a loan application, pre-qualification, pre-approval, commitment to lend, or offer of credit, and results do not guarantee the terms any lender will extend.

BAH figures reflect published Department of Defense rate tables for the Fort Benning, Georgia Military Housing Area and are subject to annual revision. Property tax figures are county-level approximations and vary by parcel, exemption status, assessment, and millage rate. Insurance figures are estimates and vary by property, coverage, and carrier.

Where you request that calculator results be emailed to you, we retain the inputs you provided so that we may deliver accurate results and provide relevant follow-up. We do not sell calculator data, and we do not transmit it to lenders or third parties for marketing purposes without your request.

5. Electronic Communications and Text Messaging

By submitting a form on the Site that includes an affirmative consent checkbox, you agree that we may contact you by telephone, email, and SMS text message regarding your real estate interests, including through automatic telephone dialing systems, prerecorded messages, or artificial voice, at the number you provide.

Consent is not a condition of purchasing any property, good, or service. Message and data rates may apply. Message frequency varies.

  • To stop text messages: reply STOP to any message.
  • For assistance: reply HELP, or contact us using the details in Section 12.
  • To stop marketing emails: use the unsubscribe link in any message.

We maintain records of consent, including the date, time, IP address, and page URL at which it was provided, for compliance with the Telephone Consumer Protection Act and applicable state law.

Opting out of marketing does not prevent us from sending transactional or service communications relating to an active real estate transaction.

6. Cookies and Tracking Technologies

We use the following categories:

  • Strictly necessary cookies, required for the Site to function
  • Analytics cookies, which help us understand how the Site is used
  • Functional cookies, which remember preferences and form state

You may configure your browser to refuse cookies or alert you when cookies are being sent. Disabling cookies may impair Site functionality.

Do Not Track. Some browsers transmit “Do Not Track” signals. Because no uniform industry standard for interpreting these signals has been adopted, the Site does not currently respond to them.

7. Disclosure of Information

We disclose information only as described below. We do not sell personal information, and we do not share personal information for cross-context behavioral advertising.

  • Service providers. Customer relationship management platforms, email delivery services, form processing, automation and integration services, listing alert platforms, web hosting, and analytics providers. These providers are permitted to use information only to perform services for us.
  • Our brokerage. Coldwell Banker Kennon & Parker, and its affiliated licensees, where required by our licensing obligations, franchise agreements, or transaction supervision requirements.
  • Transaction professionals. Lenders, mortgage brokers, inspectors, appraisers, title and closing agents, attorneys, contractors, and moving services — disclosed only at your request or as reasonably necessary to complete a transaction you have initiated.
  • Multiple Listing Services. Where you engage us in a transaction, transaction data may be submitted to the applicable MLS as required by its rules.
  • Legal and safety. Where required by law, subpoena, court order, or governmental request; to enforce our agreements; or to protect the rights, property, or safety of any person.
  • Business transfers. In connection with a merger, acquisition, reorganization, or sale of assets, subject to this Policy.

8. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Policy and to satisfy legal obligations. Real estate transaction records are subject to retention requirements under Georgia and Alabama law and applicable brokerage policy, which may require retention for several years following closing. Inquiry and marketing records are retained until you request deletion or the information is no longer needed.

9. Your Rights and Choices

Subject to applicable law, you may request that we:

  • Confirm whether we process personal information about you, and provide access to it
  • Correct inaccurate personal information
  • Delete personal information not subject to a legal retention obligation
  • Provide a portable copy of information you provided to us
  • Cease sending marketing communications

State privacy laws. Residents of certain states — including California, Colorado, Connecticut, Virginia, Utah, Texas, and others as such laws take effect — may have additional rights, including the right to opt out of the sale or sharing of personal information and of profiling with legal or similarly significant effects. As stated above, we do not sell or share personal information as those terms are defined under such laws.

This is particularly relevant to our clients: many are service members who reside in another state at the time they contact us. We will honor verified requests under the law of your state of residence regardless of where we are located.

Submitting a request. Email us at arrio@arrioandkelsey.com with the subject line “Privacy Request.” We may need to verify your identity before responding, and will respond within the timeframe required by applicable law. You will not be discriminated against for exercising these rights. If we deny a request, you may appeal by replying to our response.

10. Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information, including encrypted transmission (TLS), access controls, multi-factor authentication on administrative accounts, and a web application firewall.

No method of transmission over the Internet or method of electronic storage is completely secure. We cannot guarantee absolute security, and you transmit information to us at your own risk.

11. Additional Notices

Children. The Site is not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child has provided us information, contact us and we will delete it.

Third-party links. The Site links to third-party resources including the Department of Defense BAH calculator, VA.gov, school district websites, and municipal resources. We do not control these sites and are not responsible for their content, security, or privacy practices.

Out-of-state and overseas visitors. The Site is operated in the United States. If you access it from outside the United States — including from an overseas duty station — you consent to the transfer, storage, and processing of your information in the United States, where data protection laws may differ from those of your location.

Fair Housing. We comply with the federal Fair Housing Act and applicable state and local fair housing laws. We do not use personal information to discriminate on the basis of race, color, religion, sex, disability, familial status, national origin, or any other protected characteristic.

13. Changes to This Policy

We may update this Policy from time to time. Material changes will be reflected in the “Last Updated” date above and, where required by law, communicated to you directly. Your continued use of the Site after an update constitutes acceptance of the revised Policy.
