1. Acceptance of Terms
These Terms of Use (“Terms”) govern your access to and use of arrioandkelsey.com and any content, tools, calculators, or services made available through it (collectively, the “Site”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.
2. About Us
The Site is operated by Arrio & Kelsey, a real estate team affiliated with Coldwell Banker Kennon & Parker, holding real estate licenses in the States of Georgia and Alabama. Each office is independently owned and operated.
3. No Brokerage or Agency Relationship
Your use of the Site does not create a brokerage, agency, fiduciary, or client relationship between you and Arrio & Kelsey. This includes browsing the Site, submitting a form, using a calculator, requesting information, or exchanging email or text messages with us.
Under Georgia and Alabama law, a brokerage relationship arises only upon execution of a written agreement signed by both parties. Until such an agreement exists, we owe you the duties of honesty and fair dealing owed to a customer, and not the fiduciary duties owed to a client. Nothing you submit through the Site should be understood as confidential in the sense applicable to a represented client.
4. Calculators, Estimates, and Financial Information
The mortgage payment calculator, BAH budget calculator, and any other estimating tool on the Site are provided for general informational and educational purposes only.
They are not, and must not be relied upon as:
- a loan application, pre-qualification, pre-approval, or commitment to lend
- an offer or extension of credit, or a quote of any rate, term, or payment
- a representation that any lender will approve you for any amount
- a representation of a property’s value, appraised value, tax liability, insurance cost, or eventual sale price
All outputs depend entirely on the assumptions entered. Property tax figures are county-level estimates that vary by parcel, exemption status, assessed value, and millage rate. Insurance figures are estimates that vary by property, coverage, deductible, claims history, and carrier. BAH rates reflect published Department of Defense tables for the Fort Benning, Georgia Military Housing Area as of the effective date indicated within the tool; rates are revised annually and depend on your actual duty station, pay grade, and dependency status. Confirm your entitlement through the official DoD BAH calculator and your servicing finance office.
You must verify all figures with a licensed lender before making any financial decision. We are not a lender, mortgage broker, mortgage originator, financial advisor, investment advisor, tax advisor, or attorney. Nothing on the Site constitutes financial, mortgage, investment, tax, or legal advice.
5. Property and Listing Information
Property information appearing on or reached through the Site is derived from sources believed reliable but is not guaranteed accurate and is subject to errors, omissions, change of price, prior sale, lease, or withdrawal without notice.
Square footage, lot dimensions, room counts, year built, tax figures, homeowners association dues and restrictions, flood zone designation, permitting status, and condition of systems should be independently verified by you and your inspectors.
School attendance zones change. Any school information on the Site is provided as a convenience, may be outdated, and must be confirmed with the applicable school district before you rely on it in a purchase decision.
Listings displayed may be subject to the rules of the applicable Multiple Listing Service, including attribution and display requirements, and are used in accordance with those rules.
6. Fair Housing
We comply with the federal Fair Housing Act, the Americans with Disabilities Act, and all applicable state and local fair housing laws. We do not discriminate on the basis of race, color, religion, sex, disability, familial status, national origin, or any other characteristic protected by law.
We provide factual, publicly available information about communities, schools, and amenities upon request. We do not steer clients toward or away from any neighborhood, and we do not characterize communities in terms of the protected characteristics of their residents.
7. Acceptable Use
You agree not to:
- use the Site for any unlawful purpose or in violation of these Terms
- scrape, harvest, index, crawl, data-mine, or copy Site content or listing data by automated means
- reproduce, republish, or redistribute Site content for commercial purposes without written permission
- attempt to gain unauthorized access to the Site, its servers, or related systems
- introduce malware, or interfere with or disrupt Site operation
- submit false, misleading, or fraudulent information, or impersonate any person or entity
- submit another person’s contact information without their authorization
- use the Site’s forms or messaging features to transmit unsolicited commercial messages
We may suspend or terminate access for any violation, without notice.
8. Intellectual Property
Site content — including text, photographs, video, graphics, guides, layout, design, and the design and implementation of the calculators — is owned by Arrio & Kelsey or used under license, and is protected by United States copyright and trademark law.
“Coldwell Banker,” the Coldwell Banker logo, and related marks are the property of their respective owners and are used under franchise license. Other trademarks are the property of their respective owners.
You may view, download, and print Site content for personal, non-commercial use, provided you retain all proprietary notices. Any other use requires our prior written permission.
Copyright complaints. If you believe content on the Site infringes your copyright, send written notice, including the information required by 17 U.S.C. § 512(c)(3), to arrio@arrioandkelsey.com.
9. Third-Party Links and Resources
The Site links to third-party websites and resources as a convenience. We do not control them, do not endorse their content, and are not responsible for their accuracy, availability, security, or privacy practices. Your use of any third-party site is governed by that site’s terms.
10. Disclaimer of Warranties
THE SITE AND ALL CONTENT, TOOLS, AND CALCULATORS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT ANY CONTENT, INCLUDING CALCULATOR OUTPUT, IS ACCURATE, COMPLETE, CURRENT, OR RELIABLE.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ARRIO & KELSEY, ITS MEMBERS, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE OR YOUR RELIANCE ON ANY CONTENT OR CALCULATOR OUTPUT, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).
This limitation does not apply to liability arising from our own gross negligence, willful misconduct, or fraud, or to any liability that cannot be limited or excluded under applicable law. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
This section governs only your use of the Site. It does not limit, waive, or modify any duty, obligation, or liability arising under a separate written brokerage agreement, listing agreement, or purchase and sale agreement, or under Georgia or Alabama real estate licensing law.
12. Indemnification
You agree to indemnify and hold harmless Arrio & Kelsey and its members, agents, and affiliates from any claim, demand, loss, liability, or expense, including reasonable attorneys’ fees, arising out of your violation of these Terms, your misuse of the Site, or your violation of any law or the rights of any third party.
13. Governing Law and Venue
These Terms are governed by the laws of the State of Georgia, without regard to its conflict of law principles. You agree that any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Muscogee County, Georgia, and you consent to personal jurisdiction and venue in those courts.
14. Severability; No Waiver; Entire Agreement
If any provision of these Terms is held unenforceable, that provision shall be limited or severed to the minimum extent necessary, and the remaining provisions shall remain in full force. Our failure to enforce any provision is not a waiver of it. These Terms constitute the entire agreement between you and us regarding the Site, and supersede any prior understandings regarding its use. They do not supersede any separate signed brokerage or transaction agreement.
15. Changes to These Terms
We may revise these Terms at any time by posting an updated version with a new effective date. Your continued use of the Site after posting constitutes acceptance of the revised Terms.
